1. About These Terms
These terms and conditions govern all hot tub hire agreements between AJC Hot Tub Hire (“we”, “us”) and the customer (“you”). AJC Hot Tub Hire is a trading name of Alan Colbert, 8 Macbeth Road, Dunfermline, Fife, Scotland, KY11 4EG. By submitting a hire request form and/or making a deposit payment, you agree to be bound by these terms in full.
Our business operates within 30 miles of KY11 4EG (Dunfermline, Fife). All hires are subject to availability and access confirmation.
2. Booking & Confirmation
A booking is only confirmed, and your dates secured when both of the following have been received:
- A completed hire application form
- Your deposit payment (cleared funds)
Both must be received more than 7 days before your requested delivery date. We do not accept bookings made less than 7 days before delivery. This minimum notice period exists to allow proper planning, logistics and access assessment — it is not waived under any circumstances, and no discount is offered for late availability.
We reserve the right to decline any booking at our discretion, including last-minute requests, without obligation to provide a reason.
Availability is not guaranteed until confirmed in writing by us. Do not make related travel or event arrangements until you have received written confirmation from us.
3. Pricing & Payments
Deposit: A non-refundable deposit is required to secure your booking (up to 1 week — £50 / 2 weeks — £100 / 3 weeks — £150 / 4 weeks — £200). Payable via PayPal or bank transfer.
Remaining balance: Due no later than the day before delivery, preferably by bank transfer.
Security bond: £100 cash collected on delivery before set-up is complete, returned at collection provided there is no damage.
Delivery surcharge: £0.50 per mile over 15 miles from KY11 4EG (calculated over 4 journeys). Confirmed before booking.
Peak pricing: Prices may increase during summer and the festive season. A quote will be provided on receipt of a hire request form.
Extra nights: May be available at £20 per night subject to availability, agreed before your collection date.
4. Your Statutory Cancellation Rights
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, consumers purchasing services at a distance normally have a 14-day cooling-off period.
However, this right does not apply to our service. Hot tub hire is a leisure activity booked for a specific delivery date and period. Under Regulation 28(1)(h), contracts for leisure services on a specific date are explicitly exempt — the same exemption that applies to hotel bookings, holiday cottages, and event tickets.
By proceeding with a booking you acknowledge the 14-day cancellation right does not apply, and that the cancellation terms in Section 5 govern your hire.
5. Cancellation Policy
5.1 Cancellation by You — Before Any Work Has Been Undertaken
If you cancel before we have made any practical preparations for your hire (before loading the vehicle, arranging logistics, or undertaking any work specific to your booking):
- Your deposit is non-refundable. It covers reservation of your dates, planning and administration.
- Any balance payment already made will be refunded in full.
5.2 Cancellation or Failed Delivery — After We Have Travelled to You
Once we have set out to deliver the tub, the following applies regardless of whether delivery was successful:
- Your deposit is non-refundable in all circumstances. It is retained to cover our travel, fuel, time and preparation costs.
- If delivery was attempted but unsuccessful (for example, due to access issues not previously disclosed to us), any balance payment already made beyond the deposit will be refunded. We may at our sole discretion make a further goodwill contribution toward your costs — this is not a contractual right.
- If the tub has been successfully delivered and the hire has commenced, no refund is owed for days already delivered or for remaining hire days. We may at our sole discretion offer a partial goodwill refund for unused days in genuinely exceptional circumstances — this is not a contractual right and will be assessed case by case.
5.3 Cancellation by Us
If we need to cancel — for example, where conditions make safe delivery impossible — we will give you as much notice as possible and provide a full refund of all payments made including the deposit. This is your sole remedy in such circumstances.
6. Access Requirements
You are responsible for ensuring adequate access from the kerbside to the siting location before booking. Minimum clearances are listed on our Hire FAQ page.
We ask that you send a short video or series of photos via WhatsApp before your booking is confirmed, so we can identify any access issues in advance.
If delivery is aborted due to access issues not previously disclosed, the deposit is retained and Section 5.2 applies.
7. Care of the Hot Tub
During your hire you must: follow chemical maintenance instructions; keep the cover on when not in use; not allow unsupervised use by children; not use the tub under the influence of alcohol or impairing medication; not add any substances to the water other than those we provide; not allow water temperature to exceed 40°C; and inform us immediately of any damage or malfunction.
Damage beyond normal wear will be assessed at collection. Repair or replacement costs will be deducted from your bond and, if costs exceed the bond, you will be invoiced for the difference.
8. Power & Water Supply
You must provide a 13-amp weatherproof, RCD-protected outdoor socket within 1.5 metres of the tub. Do not use extension leads. You must also provide access to an outdoor tap for filling. Failure to provide a compliant power supply may result in the hire not proceeding, in which case Section 5.2 applies.
9. Liability
We accept no liability for: injury or illness arising from failure to follow our safety instructions; property damage caused by inadequate access or an unsuitable siting surface; or loss of enjoyment from any breakdown. Nothing in these terms limits our liability for death or personal injury caused by our negligence, or any liability that cannot be excluded by law.
10. Governing Law
These terms are governed by the laws of Scotland. Disputes will be subject to the exclusive jurisdiction of the Scottish courts.

We understand that some customers prefer to withhold part of their payment until we arrive, and we appreciate that this comes from a place of caution. However, please be aware that the hot tub will not be left at your property until all outstanding payments have been received and cleared — including the remaining balance and the £100 cash security bond. If any payment is outstanding on delivery day, we reserve the right to delay set-up or decline to leave the tub until all amounts are settled. We would always prefer to discuss payment concerns in advance so that delivery day goes smoothly for everyone.
Security bond: £100 cash, collected on delivery before set-up is complete. Returned in full at collection provided there is no damage to the tub or equipment.

The deposit can be paid via PayPal (no account required) or bank transfer. Contact us for bank details.
Remaining balance: Due no later than the day before delivery, preferably by bank transfer. If bank transfer is not possible, contact us as soon as possible to arrange an alternative.
Security bond: A £100 cash bond is collected on delivery before set-up is complete. The tub will not be left without this payment. The bond is returned in full at collection, provided there is no damage to the tub or equipment.
Delivery surcharge: Hire pricing includes delivery up to 15 miles from KY11 4EG. A surcharge of £0.50 per mile applies for every mile over 15 (calculated over 4 journeys). This will be confirmed before booking.
Peak pricing: Prices may increase during peak periods including summer and the festive season. A quote will be provided on receipt of a hire request form.
Extra nights: Additional nights may be available at £20 per night, subject to availability. This must be agreed before your collection date.
4. Your Statutory Cancellation Rights
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, consumers who purchase services at a distance (online or by phone) normally have a 14-day cooling-off period in which they may cancel without penalty.
However, this right does not apply to our service. Hot tub hire is a leisure activity booked for a specific delivery date and period of performance. Under Regulation 28(1)(h) of the 2013 Regulations, contracts for leisure services provided on a specific date are explicitly exempt from the 14-day cancellation right. This is the same exemption that applies to hotel bookings, holiday cottages, concert tickets and similar leisure reservations.
By proceeding with a booking you acknowledge that the 14-day statutory cancellation right does not apply, and that the cancellation terms set out in Section 5 below govern your hire agreement.
5. Cancellation Policy
5.1 Cancellation by You — Before Delivery
If you cancel your hire before the tub has been delivered:
- Your deposit is non-refundable in all circumstances. The deposit is taken to cover the cost of reserving your dates, planning, access assessment and administration — all of which are incurred at the point of booking regardless of whether the hire proceeds.
- If your balance has already been paid, no refund of the balance is owed. However, we may at our sole discretion offer a partial goodwill refund of the balance where we consider the circumstances to be genuinely exceptional. This is not a contractual right and will be assessed case by case.
5.2 Cancellation by You — During Hire
If you request early collection or wish to end your hire before the agreed collection date:
- No refund is owed for any part of the hire already delivered.
- No refund is owed for remaining hire days. The tub has been reserved exclusively for you and cannot be reallocated at short notice.
- We may at our sole discretion offer a partial goodwill refund for unused days where we consider the circumstances to be genuinely exceptional. This is not a contractual right.
- Early collection will be arranged at a time convenient to us and is not guaranteed to be immediate.
5.3 Cancellation by Us
In the unlikely event that we need to cancel your hire — for example, due to unforeseen circumstances that make safe delivery impossible — we will give you as much notice as possible and provide a full refund of all payments made, including your deposit. This is your sole remedy in such circumstances.
6. Access Requirements

We ask that you send us a short video or series of photos from the kerbside to the siting location via WhatsApp before your booking is confirmed. This allows us to identify any potential access issues before delivery day.
If we arrive on delivery day and access is not possible due to inadequate clearance, obstructions, or conditions not previously disclosed, we reserve the right to abort delivery. In this situation, no refund of the deposit will be made and any balance already paid may be retained to cover costs incurred.
7. Care of the Hot Tub
During your hire you are responsible for the safe and proper use of the tub and all equipment provided. You must:
- Follow the chemical maintenance instructions provided at delivery
- Keep the cover on the tub when not in use to retain heat and protect the water
- Not allow children to use the tub unsupervised
- Not use the tub under the influence of alcohol or medication that impairs judgement
- Not add any substances to the water other than the chemicals we provide
- Not allow the water temperature to exceed 40°C
- Inform us immediately of any damage, malfunction or water quality issues
Any damage to the tub, cover, pump, pipework or equipment beyond normal wear will be assessed at collection. The cost of repair or replacement will be deducted from your security bond and, if costs exceed the bond, you will be invoiced for the difference.
8. Power & Water Supply
You must provide a 13-amp weatherproof, RCD-protected outdoor socket within 1.5 metres of the tub. Do not use extension leads — the tub’s own cable is the correct length. Failure to provide a compliant power supply may result in the hire not proceeding, in which case Section 5.1 applies.
You must provide access to an outdoor tap for filling. We handle the filling on delivery.
9. Liability
We take all reasonable steps to ensure the safe delivery, set-up and operation of our equipment. However, we accept no liability for:
- Injury or illness arising from failure to follow our safety and chemical instructions
- Damage to property caused by the customer’s failure to ensure adequate access or a level, stable siting surface
- Loss of enjoyment or consequential losses arising from any breakdown or issue with the tub
Nothing in these terms limits our liability for death or personal injury caused by our negligence, or any other liability that cannot be excluded by law.

These terms are governed by the laws of Scotland. Any disputes will be subject to the exclusive jurisdiction of the Scottish courts.
